BARGAINING 2007 Update on Bargaining Re: Mediator's Recommendations

We have just been advised by Mediator Brian Foley that his recommendations for settlement may be delayed until possibly as late as October 8, 2007.

He has committed to do everything possible to get them to the parties earlier if possible. Members are advised to monitor the CUPE 15 website (www.cupe15.org) for further information as it becomes available. It is important to note that CUPE 15 has made our submission to Mr. Foley on September 24th, and CUPE 1004 made theirs on September 26, 2007. We understand that the City of Vancouver will be meeting with Mr. Foley over the weekend. Mr. Foley is also meeting with CUPE 391 and the Vancouver Public Library the week of October 1, 2007.

Your bargaining committee is committed to ensuring that a copy of the mediator’s recommendations for settlement will be available as soon as possible after we receive them. We will also ensure that you will have an opportunity to ask questions and to review the recommendations with your bargaining committee prior to voting.

does a mediator get paid a base salary for his input or does he get "billable hours"???? I'm starting to think of this whole conflict as "the gong show"

October 8! How long before CUPE starts accusing Foley of being in cahoots with the NPA? Is it possible to mediate in 'bad faith'?

The province had great success in getting unions to sign with incentive bonuses. Should the City try and throw back CUPE's threat that the longer the srike goes the more bonuses will be needed; with a bonus structure that declines over time with the clock starting to tick after the mediator releases his report. I'm sure some will decry such a tactic as more Boulwarism, but as CUPE as tried it itself it may be difficult to criticize it directly.

Does anyone have any inside scoop on what could possibly taking so long?? What will happen if Cupe does not agree with the meditors recommendations?

Delay is so Foley can meet with 391 after Cameron stood aside, so Foley can present all 3 local(s)recommendations at the same time as there are some similar issues, and it wouldn't be fair for management to see what has taken place in one local ahead of another - I believe. Something like that.

attempts to get others to see your way of thinking is accomplished through clear, concise and tactful words backed up by facts to support it.

In negotiation, a Boulwarism is an offer or counter-offer that is not meant to be negotiated. This "take it or leave it" strategy is named after Lemuel Boulware,

I'm not sure if you understand that the offer we were told to take or leave was a ripped up previous contract devoid of items already hard fought for.

The union did not say take it or leave it - they said lets talk

your energies might be better spent asking why a labour relations bureau is required when the NPA have to hire a mediator? and perhaps lobbying your provincial govt about spending all your money for labour peace when they could of used Boulwarism.
I don't know how many employess they have but I do know a computer service person who got $3500 and I know the bonuses ranged higher for others higher up the professional scale

Do CUPE locals expect a cash payment as part of a settlement? If they do, how much do they expect?

Blackbird: you'd really describe the behaviour of the Vancouver CUPE locals as 'great' during this strike? Most other area locals got the maximum money deal after very short or no strikes; those are the Union leaderships' that can be described as 'great'.

I would like to request that everyone wait until the real story comes out about the assault at the VSO

I know this man personally and he is just not like that, plus as he is arthritic with two hip replacements my friends and I don't think he could kick, there's something not right about this

suffice it to say a civil liberties lawyer could have a field day, actually I don't see it making it to court - IT'S RIDICULOUS

Our Brother took it on the chin, what I would call police state behavior for the rich -telling the officer as he was released the next morning that he was not very happy with his experience and when asked why, he said cause there was no chocolate on his pillow
